Commentary by Attorney Michael Grossman

When I read about a crash like this, my first thought is that I hope investigators take the necessary steps to determine exactly what happened. Pedestrian-involved crashes often seem straightforward, but experience has shown me that they can be more complicated than they first appear. That’s why a thorough investigation must address three critical questions.

First, did the authorities conduct a thorough investigation? The report states that the pedestrian was struck by a northbound Nissan Juke, but it does not provide details on how or why the collision occurred. A complete investigation should examine the roadway conditions, lighting and visibility at the time of the crash. Was the area well-lit, or was poor visibility a factor? Were there any road hazards or obstructions that may have played a role? Additionally, it’s important to determine whether the driver had sufficient time and distance to react. Without answering these questions, it’s difficult to say with certainty how the crash happened.

Second, has anyone considered whether a vehicle defect played a role? It’s natural to assume driver error or pedestrian behavior caused the crash, but mechanical issues can’t be ruled out without a forensic examination of the vehicle. Did the Nissan Juke experience braking issues, steering malfunctions or faulty headlights that reduced visibility? Modern vehicles rely on electronic systems for everything from braking to collision detection, and a failure in any of these components could contribute to a crash. However, if investigators don’t secure the vehicle for further examination, these questions may never be answered.

Lastly, has all the electronic data from the crash been preserved? A 2013 Nissan Juke is equipped with an engine control module that records key data, such as vehicle speed, braking activity and steering input. This information could clarify whether the driver attempted to slow down or swerve before impact. Additionally, nearby surveillance cameras or traffic footage might provide valuable evidence, and cell phone data could help rule out potential distractions. If this data isn’t collected promptly, it may be lost, making it more difficult to reconstruct the events leading up to the crash.

At the end of the day, pedestrian-involved crashes deserve the same level of scrutiny as any other serious accident. Those affected deserve clear answers about what happened, and the only way to provide those answers is through a complete and thorough investigation. Ensuring that authorities examine all possible factors is essential to understanding the cause of the crash.
