Commentary by Attorney Michael Grossman

While I certainly don’t know more about this crash than what little is available publicly, I’m concerned anytime I read about crashes involving teenage drivers. I talk a lot about single-vehicle wrecks on this blog and how they can involve less common, possibly unavoidable factors. Did a tire blow out? Were there road hazards? Was there an unknown vehicle defect? Was there missing signage or other issues with the roadway? Common or not, readers generally understand the importance of considering all kinds of possible factors that drivers may not really have control over.

But when the driver is young and inexperienced, folks suddenly decide there is no room to be charitable. It’s true that younger drivers are statistically more likely to make mistakes, but that’s no excuse for jumping to conclusions. Even when they do make mistakes, there are legal complexities that preliminary crash investigation aren’t likely to address on their own. So while I don’t know what happened in this crash, I see no reason the investigations should be any less thorough and open-minded than after any other serious accident. It remains to be seen if authorities are exercising that level of care.
