While people tend to just write off situations like this, assuming there’s nothing to consider when only one vehicle is involved, passengers in a commercial truck raise some unique challenges. Generally speaking, it’s important to distinguish if an injured passenger was a co-worker or some other individual.
For example, a co-worker’s path forward may be the same as the driver’s—they’re on the job, so their situation falls within Texas work injury law. However, a friend, family member, spouse, or other acquaintance is just along for the ride. Typically, their path forward would be similar to that of someone in a completely different vehicle hit by a commercial truck. After all, it’s highly unlikely the passenger did anything to contributing to the accident.
So as open-and-shut as some may think this crash is, it could actually be quite a bit more challenging than what authorities are used to dealing with on their own.
