Commentary by Attorney Michael Grossman

When a semi-truck crashes into the back of another vehicle, it’s easy to jump to the conclusion the truck driver did something wrong. To be blunt, that is the most likely explanation. There are unusual circumstances a driver isn’t always able to avoid, of course, but it’s more likely something like speeding or distracted driving led to the crash. That said, commercial vehicle accidents often involve problems that begin before a truck driver ever gets behind the wheel. Is that something authorities are looking into?

Simply put, I’ve handled hundreds of commercial vehicle accident cases. Many accident like this happen at least in part due to an employer behaving recklessly. Was this driver being pressured to meet unreasonable deadlines? Was their boss hounding them on the phone? Were they inexperienced or poorly trained? Did they have a history of being reckless the trucking company overlooked or ignored? Did something like poorly maintained brakes or tires contribute to the crash?

Authorities should be able to answer these kinds of questions, but that may not happen if all of their efforts are focused solely on the crash scene. Letting that sort behavior slip under the radar only allows negligent companies to continue putting lives at risk. In my experience, victims and families aren’t satisfied just having some bad guy to blame. They want to be sure all wrongs that led to their hardships are set right. It remains to be seen if authorities alone will be able to accomplish that here.
