Commentary by Attorney Michael Grossman

When a young driver is seriously injured in a single-vehicle crash, particularly late at night, the assumption is often that inexperience or overcorrection led to the outcome. But in my experience, especially when the cause of the crash remains unclear, those assumptions can prevent us from asking the right questions. To fully understand what happened on Interstate 35 near Roland Lane, there are three key questions that should be asked.

First, did the authorities conduct a thorough investigation? Crashes that happen after dark require careful attention to visibility, road conditions, and the design of the surrounding area. Was the shoulder narrow or poorly marked? Was there an obstacle that forced the evasive maneuver? Officials should have examined whether the layout of the highway and placement of the culvert made it more likely that a brief misjudgment would result in a rollover. If these details weren’t fully documented, a second look from an independent investigator may be necessary to reconstruct what actually happened.

Second, has anyone looked into whether a mechanical issue or defect played a role? If the Kia Optima took evasive action that didn’t produce the expected result, that raises questions about whether the vehicle’s steering, suspension, or braking systems were functioning properly. Even a momentary delay in response can be catastrophic, especially at highway speeds. These kinds of mechanical failures are easy to miss unless the vehicle is preserved and examined by a qualified forensic team.

Lastly, has all of the electronic data from the vehicle been collected? The Kia Optima likely contains an event data recorder that stores information such as speed, brake use, throttle position, and steering input in the moments before the crash. That data could reveal whether the driver attempted to avoid an obstacle, whether the vehicle responded appropriately, and how fast it was traveling at the time of impact. Additional context may come from GPS records or surveillance footage, but like any form of crash-related evidence, this information must be secured quickly before it’s lost.

When the details of a crash remain uncertain and a young person is seriously injured, assumptions aren’t enough. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
