Houston, TX — September 16, 2024, Sebastian Benitez-Mendoza was killed due to an alleged drunk driver accident late Monday off the Crosby Freeway.
Authorities said in preliminary statements that the crash happened off the corner of U.S. 90 and Sheldon Road.
It appears that 21-year-old Sebastian Benitez-Mendoza was on northbound Sheldon at the time. From the main lanes of the freeway, authorities say a pickup lost control and ran off the roadway. It careened onto Sheldon where it then crashed into Benitez-Mendoza. As a result, Benitez-Mendoza was killed.

Authorities at this time allege that the other driver was intoxicated at the time, and they say they’re pursing a charge for felony murder.

If the allegations mentioned by investigators are true, I hope they go beyond the crash itself to find out if the alleged drunk driver was unlawfully over-served by a local alcohol provider. They, too, can be held accountable for their role in a drunk driving accident, whether that’s through criminal investigations, fines, or civil liability.
The reason I bring this up specifically is because it’s an area of the law that rarely gets the attention it deserves. Authorities (rightfully) make a significant effort to hold drunk drivers accountable, but then they tend to move on unless there’s some extra motivation for them to get the full story. In Harris County, authorities are generally more proactive than in other parts of Texas when it comes to taking these steps. But even they let many negligent alcohol providers slip through the cracks.
Simply put, I’ve handled hundreds of cases against negligent alcohol providers. I can’t count how many times those cases involved families who never even realized there could have been an accomplice responsible for harming their loved ones. They only learned after speaking to us, then our investigations would reveal such egregious behavior by those establishments that the families are shocked authorities would allow them to continue putting the community in danger.
Again, authorities here may be working behind the scenes to see there’s fully accountability for this. But I learned a long time ago never to take that for granted. That’s why the public needs to be informed about these alternative legal avenues. Authorities are more likely to pursue both drunk drivers and the alcohol providers who unlawfully over-serve them when there is a clear interest from the public to see both wrongdoers held accountable. Whatever ultimately happened here, hopefully steps are taken here to ensure that no one is let off the hook.
