Montgomery County, PA — December 8, 2023, Sean Terwilliger was killed following a tractor-trailer accident at around 6:30 a.m. along Interstate 476.

Authorities said in preliminary statements that the incident occurred along the southbound lanes of the Pennsylvania Turnpike near mile marker 36.

According to officials, 40-year-old Sean Terwilliger was in a utility truck that pulled over on the right shoulder due to possible insecure cargo on the truck. While on the shoulder, authorities say Terwilliger got out of the truck and was outside checking on the cargo. That’s when, according to police, a tractor-trailer somehow went across the fog line and sideswiped the utility truck, hitting and killing Terwilliger.

There were no other reported injuries, and authorities do not say if they’re considering charges or citations.

I certainly don’t know anything more about this crash than what’s already reported to the public. But how often does an 18-wheeler move onto the shoulder and hit someone without the truck driver doing anything wrong? It probably wouldn’t surprise folks that across hundreds of commercial vehicle wrecks I’ve litigated, I can’t recall a single time where that occurred.

Maybe that isn’t what happened here, and maybe evidence will show this all was just an unavoidable tragedy. But if investigators are able to look into things like cell phone records, any available dash cams, hours of service logs, driving history, training records, and other vital details, experience tells me that it’s more likely that there will be mistakes to answer for.
