Commentary by Attorney Michael Grossman
When accidents like this occur, many people may instinctively focus on surface-level causes, such as a potential driver error. However, my decades of experience handling commercial truck accident cases have shown that crashes involving large trucks often have more complex underlying factors. A thorough investigation will be necessary to uncover the full story of what happened in this incident.
One of the first areas investigators should examine is the truck itself. Was it in proper working condition at the time of the crash? Commercial trucks are subject to tremendous wear and tear, and regular maintenance is essential to keeping them safe on the road. If a mechanical failure—such as brake malfunctions or steering issues—caused the truck to veer off the highway, determining whether the truck’s maintenance schedule was followed will be critical. Negligence in this area could point to liability on the part of the trucking company or a third-party maintenance provider.
The driver’s actions and condition also merit scrutiny. Was the driver distracted, fatigued, or impaired? Did they make an evasive maneuver due to unexpected hazards, or were they facing pressures like tight deadlines that may have led to unsafe driving behavior? The trucking industry often imposes significant demands on drivers, and the role of those pressures in crashes must be examined to prevent similar incidents in the future.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by this incident receive the clarity and closure they deserve.
