Commentary by Attorney Michael Grossman
Any mention of intoxicated driving is obviously serious, but it sometimes leads people to jump to conclusions or get tunnel vision. Authorities unfortunately are not immune to this. Victims and families generally want answers, first and foremost. Authorities, however, sometimes move on once they have someone facing charges, leaving gaps in the investigations.
I’ve handled hundreds of cases with details similar to this one. There’s rarely just one factor that needs attention. For example, it could be that there’s a local bar responsible for unlawfully over-serving the alleged intoxicated driver. It could be there were extenuating circumstances, such as defective seatbelts or airbags, or maybe there was another driver involved who left the scene. Likely or not, it’s important to ensure investigations are considering all possible factors and ruling things out with evidence, not simply because there’s already someone taking the blame. If nothing else, the victim’s loved ones deserve to know they’re getting the whole story.
