Commentary by Attorney Michael Grossman
There could be more details regarding what happened here which would explain why only one person was seriously injured while the other person was apparently fine. My concern, though, is there’s a possibility that often goes overlooked: a vehicle defect.
For example, I handled a case a while back where authorities blamed a driver’s serious injuries on them not wearing a seatbelt. However, it turned out officers more or less jumped to that conclusion without clear evidence. We had independent investigators with more training and better equipment examine the vehicle, and it turned out the seatbelt was defective. Had it worked properly, the driver likely would have avoided serious injuries.
So while there could be ordinary circumstances surrounding this accident, investigations could also show that the safety features which protected one of the drivers involved here failed to protect the other. If nothing else, it’s important to know whether or not that’s something authorities are at least working to rule out.
