Right now, authorities say alcohol was a factor in the crash. Obviously, if that’s true, it carries with it some serious potential consequences. But as much as people understandably focus on a driver’s actions following such accidents, there could actually be an outside party responsible for the resulting injuries: a bar.
In Texas, bars, restaurants, liquor stores, and other establishments can be responsible for illegally over-serving someone whose intoxication then leads to an accident. It exposes them to potential consequences, such as criminal investigations, fines, license suspensions, and even liability for the victims’ injuries.
Considering I’ve handled hundreds of cases involving negligent alcohol providers, it’s incredibly common, yet it rarely gets attention from the public. In many situations, there’s a local alcohol provider breaking the law and contributing to serious accidents who simply is let off the hook because authorities felt content to put all the blame on the drivers involved. I can’t say if that happened here, but I hope authorities have at least been thorough enough to ensure those involved know what steps may come next for them.
