Commentary by Attorney Michael Grossman

When it comes to pedestrian accidents, people can sometimes be quick to jump to conclusions. They believe that everything comes down to who had the right-of-way. That’s obviously important, but there could be extenuating circumstances that a typical preliminary investigation may overlook.

For example, I handled a case not long ago involving a man who was struck along a freeway. The family wasn’t really getting any clear answers, so they wanted a second set of eyes on the situation. Through our investigations, we found the man had been out drinking with friends. The establishment they were at proceeded to unlawfully over-serve the man beyond the point his intoxication was a clear danger to himself. Later, the man responsibly chose not to drive, but he became disoriented trying to walk home and ended up wandering off the sidewalk and into traffic.

I’m not saying anything like that happened here, but the truth in that example only came to light because the family happened to be motivated to ensure they were getting all the facts. Had things just been left at the shallow reports authorities gave them, the family might never have learned the truth. Perhaps nothing unusual contributed to this particular accident, but that’s up to the evidence to say.
