Harris County, TX — March 30, 2024, Samantha Matocha and Theodore Matocha were injured in an alleged drunk driver accident at 3:00 a.m. on Eastex Freeway.
Authorities said in preliminary statements that the crash happened on northbound lanes of the freeway near Aldine Mail Route Road.

According to officials, 33-year-old Samantha Matocha, 36-year-old Theodore Matocha, and a 12-year-old were in a Chevy Silverado hauling a trailer along I-69/US 59. While doing so, a Chevy Sonic somehow hit the trailer from behind. This caused the pickup to crashed into the HOV barricade.
As a result of the crash, Samantha Matocha had serious injuries. Theodore Matocha and the kid in the pickup may have had minor injuries. The other driver was allegedly under the influence of alcohol and drugs at the time of the crash. Authorities recommended charges for intoxication assault.

I’ve had people ask me about crashes where police believe both drugs and alcohol are involved. Doesn’t that make things more challenging? It can, but generally speaking, alcohol is almost always the more significant intoxicant.
Our firm has had cases against bars who contributed to someone’s injuries by over-serving a drunk driver who was also on drugs. They might try to argue it was the drugs that caused the accident, but then the evidence makes it clear that, the alcohol alone was enough to make someone dangerously intoxicated. Short of hardcore opiates, there just aren’t that many drugs that are more detrimental to one’s ability to drive than alcohol. If this crash ended up otherwise, it’d likely be the exception to prove the rule. If it’s like most similar ones I’ve seen though, any confirmed drug usage would likely be second fiddle to any confirmed intoxication by alcohol.
