Commentary by Attorney Michael Grossman

It’s possible that authorities are withholding more conclusive statements until they have more evidence to go off of. Folks tend to think that investigating a drunk driving accident is straight-forward. Sometimes, though, there’s a lot more to it than just getting a driver’s BAC. That’s especially true if there’s a negligent alcohol provider responsible for unlawfully over-serving the driver.

For example, I’ve handled hundreds of cases against negligent alcohol providers who unlawfully over-served a driver and contributed to a serious accident. We look at all kinds of evidence to prove someone was intoxicated at the time of a crash. This can include credit card statements, witness testimony, testimony from medical experts, security camera video, and even texts and social media posts from the moments prior to the accident. That all can take time and even court orders, so a police investigation trying to be as thorough as possible might not immediately be confident enough to start filing charges.

Of course, that all depends on whether or not authorities are investigating things that thoroughly. Generally speaking, I’m not used to seeing authorities investigate beyond a drunk driver’s actions alone. So it’s possible authorities are taking time to be thorough here, but it’s also possible they’re just not giving the crash the attention it deserves. I would certainly hope steps are being taken to ensure the victim’s loved ones know they’re getting the full story.
