Investigators said that Russell Williams and Cleys Williams, both 58 at the time, were in a Toyota pickup said be going westbound on Walnut Hill. While crossing Midway, it appears an eastbound Mitsubishi Outlander failed to yield making a left turn, and the vehicles collided.

Both Russell Williams and Cleys Williams had reported injuries, with the latter’s injuries described as serious. It’s unclear if the other driver was hurt or not. That Mitsubishi driver was allegedly under the influence of alcohol, police said, but it’s unclear if any charges were filed.

Authorities are usually very quick to recommend charges in these circumstances, so it seems unusual they didn’t mention any here. Perhaps they’ve been more thorough since the public statements, or perhaps there are unusual circumstances that make this crash an exception. My hope, though, if these allegations are true, is that they’re waiting to talk about charges because they have to look into where the driver got their alcohol.

While it doesn’t get talked about enough, drunk drivers are rarely the only ones who broke the law with crashes like these. It often comes to light that they were over-served by a local alcohol provider. An establishment illegally over-serving someone opens themselves up to all kinds of possible consequences, including criminal investigations, civil liability for the resulting accident, and possible fines and license suspensions from the TABC.

To be rather frank, authorities don’t often include this sort of thing in the scope of their investigations into drunk drivers. However, they’ve become better over the years as awareness of negligent alcohol providers spreads throughout Texas. Having watched that level of awareness through my work across 30 years, it’s encouraging to see improvements. But it remains to be seen if this is yet another situation where investigators were behind the curve.
