Commentary by Attorney Michael Grossman
People tend to think car accidents like this are simple or straight-forward, but that’s not usually how things go. It isn’t necessarily considering the likely factors that makes crashes complicated but rather ruling out less common factors. For example, a recent case I handled involved someone who had a defective seatbelt. They were seriously injured when they otherwise would have been okay. Authorities, however, missed that entirely. In fact, they blamed the driver for not wearing their seatbelt, and it took independent investigations to set the record straight. Independent investigations here could simply rule out such possibilities, but it’s important that the evidence is able to say that for sure one way or the other.
