Some might assume there would be nothing else to discuss. It’s not like a tire blowout is avoidable, right? Well, that’s not always true. In fact, they are often preventable.
For example, I’ve handled hundreds of commercial vehicle accident cases, many of which involved companies who routinely skipped maintenance work on their trucks. A lot of trucks are out there on worn tires which need to be replaced, but companies kick that can down the road in the hopes they can squeeze as many miles out of the worn tires as possible. More responsible companies know that replacing tires can save lives, which is why they do so as regularly as possible. So when companies or drivers fail in this regard, it’s important they face appropriate consequences so they don’t harm anyone else in the future.
Now, it could be this truck accidentally hit something in the road, puncturing the tire. That’s not really something anyone is responsible for, generally speaking. It could also be this is an unusual case of a tire being defective due to mistakes by the manufacturer. In that case, there would have to be careful accident reconstructions to pin down the source of the problem so the appropriate steps can be taken to remedy the defect. Whatever the case may be, tire blowouts like this are rarely as simple as folks tend to assume. That’s why I have to wonder if any steps have been taken to get answers here besides just a cursory police investigation mere moments following the crash.
