Investigators said that 40-year-old Roman Delgado Sanchez was on foot at the time in the area of Coit Road. Due to events unclear right now, a northbound vehicle struck Sanchez. As a result, Sanchez was killed.

Over the years, I’ve found that people are generally quick to blame pedestrians before they know any actual facts about the accident. Obviously, people can make mistakes. Some of those people are drivers, who might be on their phone or going too fast. However, there are also other factors that can make a pedestrian accident a lot more challenging than a simple case of who had the right-of-way.

For example, I handled a pedestrian accident case not long ago where there was a local alcohol provider responsible for the accident. Our independent investigations showed the victim had been out with friends that night, and the establishment they were at proceeded to recklessly and unlawfully over-serve him. While he responsibly chose not to drive home, his intoxication caused him to become disoriented, and he accidentally wandered into the roadway where he was hit and killed.

Initially, authorities had just written off that accident as someone being in the wrong place at the wrong time. The family just wanted to be thorough, but their diligence led them to professionals who conducted more thorough investigations, and they brought to light a negligent alcohol provider whose actions contributed to the victim’s death. Had it not been for their prudence, there’s no telling if the truth ever would have been brought to light, let alone whether or not there would have been accountability.

To be clear, I’m not saying that happened here. My point is that pedestrian accidents deserve as much scrutiny as any serious car accident. Things are rarely as simple as people assume, and it’s important there are investigations into even unlikely possible factors to ensure nothing goes overlooked. If nothing else, the victim’s loved ones deserve to know they’re getting the whole story.
