Commentary by Attorney Michael Grossman
Cargo hitting an overpass on a major interstate is almost always a sign that cargo was loaded improperly. Barring some unusual circumstances, it’s not easy to load something like construction equipment without knowing the height of the load and the height restrictions along a given route.
The fact there was a collision like this strongly suggests someone either loaded the machinery wrong or failed to properly plan their route. People may immediately lock in on the truck driver, but investigations should also include the driver’s employer and any other companies that may have had a hand in loading the machinery in the first place.
At the end of the day, seeing there is accountability for the injured parties is one thing. It’s another matter to ensure this sort of thing doesn’t happen again.
