Commentary by Attorney Michael Grossman
When a crash leads to criminal charges, it often dominates the conversation. But even when recklessness is alleged, that doesn’t mean every other factor should be ignored. A deeper review can still uncover contributing issues that help explain how the situation unfolded.
1. Did the authorities thoroughly investigate the crash?
With charges filed, the focus likely shifted to the Mustang driver’s behavior. But for a fair and full understanding, investigators need to go beyond that. Did they laser map the scene? Did they analyze the vehicles’ final positions to reconstruct their paths? Were both drivers’ actions prior to impact reviewed, including how much time Zavala had to react? The pursuit of justice should include a technically sound investigation—not just a legal one.
2. Has anyone looked into the possibility that a vehicle defect caused the crash?
If the Mustang really crossed the median without braking or correcting, it’s natural to assume the driver was acting recklessly. Still, even in those circumstances, a malfunction—like a stuck accelerator or sudden steering issue—could have contributed. The vehicle caught fire, which raises questions about the state of the car before the crash. Was it maintained? Did it already have problems? These angles matter, even if the driver’s conduct appears to be the main issue.
3. Has all the electronic data relating to the crash been collected?
Both vehicles might hold electronic clues. The Mustang’s data could show whether there was any attempt to brake or steer, while the pickup might reveal if Zavala tried to avoid the crash. Phone records could confirm distraction or impairment, and dash or traffic camera footage could help verify the sequence of events. With a criminal case in play, collecting and preserving this kind of data becomes even more important.
Legal outcomes often settle one question, but they rarely tell the whole story. For everyone affected, it’s worth asking whether the crash was fully understood—not just prosecuted.
Takeaways:
- Criminal charges don’t replace the need for a full crash investigation.
- Mechanical failures should still be considered, even in reckless driving cases.
- Vehicle data can clarify events in ways eyewitness accounts cannot.
