If blood test results confirm that intoxication was a factor here as authorities suspect, there may be other issues to consider. Some may think I’m talking about ensuring the right charges follow, but I’m actually emphasizing the importance of finding out where the alcohol came from. Under Texas dram shop law, a local business may need to be held accountable for over-serving the alleged DWI driver.

Dram shop law makes it illegal for licensed alcohol providers to sell or serve more drinks to obviously intoxicated patrons. Doing so presents a clear and serious hazard both to their customers and to the public at large. Despite the dangers it creates, countless businesses routinely over-serve their customers and send them on their way at night’s end without a second thought.

Not every drunk driving case involves a dram shop violation, the possibility deserves investigation any time alcohol use is connected to serious injuries. If bad bars are never held responsible for their negligent over-service, they’ll never change their ways and the roads will stay dangerous for everyone. So if intoxication is confirmed as a factor, will authorities make sure to find out where that intoxication took place?
