Monroe County, NY — April 17, 2023, Robert Tincani was killed and another driver was injured following an accident involving multiple 18-wheelers on the Thruway.
The incident happened in the Chili area along westbound lanes of I-90. There appeared to be an initial collision in which a Toyota Rav4 struck a tractor-trailer driven by 75-year-old Robert Tincani. The Toyota became disabled in the right lane of travel while Tincani pulled to the shoulder. Tincani and the other driver apparently exchanged information off the side of the Thruway.

Some time later, another 18-wheeler crashed into the Toyota, then overturned. This caused the 18-wheeler to hit Tincani, resulting in fatal injuries. The other 18-wheeler driver was said to have non-life-threatening injuries. It appears no one else was hurt. Right now, additional details are unavailable.
Commentary by Attorney Michael Grossman
It’s truly awful to see a man just going about his business, doing his job and providing for himself and his loved ones in what’s arguably the most important job in America only to fall victim to circumstances that in all likelihood were entirely beyond his control. The news says the victim was rear-ended, then pulled safely onto the shoulder, and then exchanged information with the other driver in the first collision. What else could anyone ask of a responsible truck driver?
The concern is if the second 18-wheeler driver involved was also a victim of circumstance rather than someone engaging in reckless behavior. It stands out that the Toyota involved in the initial collision was apparently in the lane of travel, but details don’t say how visible or avoidable the vehicle was. Considering how much time passed between the two collisions, I have to wonder how many other drivers were able to safely pass by the crash scene without incident. Why was it different for the second truck driver? What prevented them from avoiding a collision that ultimately took a man’s life?
