Commentary by Attorney Michael Grossman

When it comes to accidents like this, a lot of people just assume it’s all about if the victim was in a crosswalk or not. But things aren’t always so simple. Generally, it’s about whether or not the collision was reasonably avoidable. For example, if a pedestrian is in the middle of the road, but they’re clearly visible and far away enough that a driver could stop or go around them, drivers have a responsibility to do so. They can’t just hit someone simply because they have the right-of-way. But, if evidence shows the driver had no reasonable chance of avoiding the victim, it would be ridiculous to hold them responsible. So with this accident, I wouldn’t say there’s enough available information here to really say what happened. There could still be more to the story authorities have yet to address.
