Waxahachie, TX — September 14, 2024, Robert Hinson and one other were injured following an alleged drunk driver accident at around 5:19 a.m. along U.S. 287.

Authorities said in preliminary statements that the incident took place in the area of the U.S. 287 and Business Highway 287 split southeast of the city.

It appears that 70-year-old Robert Hinson was in a Toyota Tundra going southeast along U.S. 287. An Audi hit Hinson’s vehicle from behind, causing the Tundra to veer across the median and overturn. Due to the collision, Hinson had serious injuries while the other driver had moderate injuries.

Authorities allege that the Audi driver was under the influence of alcohol at the time. If that’s true, folks tend to think that means driver faces charges, and that’s that. When these incidents are handled properly, though, there could be a lot more to the story. This is because many alcohol-related accidents involved people who were unlawfully over-served by an alcohol provider, and that establishment could be responsible for their role in the crash.

Simply put, it’s illegal in Texas for bars and other similar establishments to over-serve someone who is obviously intoxicated. If they do so, it exposes them to potential criminal investigations fines, license suspensions, and liability for the resulting injuries. But when all of the focus rests on the drunk drivers, these establishments too often are let off the hook. It’s one of the reasons why I’ve rarely seen authorities taking their own steps to hold alcohol providers accountable despite the fact I’ve handled hundreds of cases against negligent providers.

It could be that authorities have been more thorough here. That said, it’s best that folks never take that sort of thing for granted. Getting clear answers often requires independent investigations beyond police efforts. It certainly wouldn’t be unusual if the same proved true here.
