Guadalupe County, TX — October 15, 2023, Robert Guelich Jr. and one other were injured after a single-vehicle accident at around 9:45 p.m. along F.M. 725.

According to officials, the crash took place near mile marker 494 of F.M. 725, just off Elm Creek Road.

Investigators say that 48-year-old Robert Frank Guelich Jr. and a 42-year-old passenger were in a Jeep Wrangler going southbound along F.M. 725. At a curve in the road, the vehicle somehow lost control, and it swerved off the left side of the roadway. There, the Jeep overturned into a pasture.

As a result of the crash, Guelich and his passenger had injuries described as incapacitating.

Current information from authorities alleges that alcohol contributed to the crash. There may be charges pending, which of course isn’t unusual when authorities allege someone was intoxicated behind the wheel. What bothers me is when that’s all authorities care about. What do I mean by this?

Look, I can’t speak to whether or not the allegations here are true. Regardless, everyone can agree driving drunk is a mistake, and there are of course potential legal consequences for such a mistake. But not everyone knows there are others who can face charges after crashes like this, such as a bar or other similar establishment if they over-served the driver. A bar, for example, contributing to crashes like the one described here can find themselves liable for injuries, watching bartenders put in handcuffs, and paying fines for various TABC violations.

Despite the numerous potential consequences a business can rightfully face for breaking the law, authorities are often content just putting all the blame on one person. Even if that person made a mistake, isn’t it only reasonable people be treated equally under the law for their own respective actions? If that’s happening here, I have yet to see information showing it.
