Commentary by Attorney Michael Grossman

When crashes like this one occur, people often assume they result from simple mistakes on the road. However, in my experience handling commercial accident cases, wrecks involving 18-wheelers often have layers of contributing factors that require thorough investigation to fully understand.

What caused the Cadillac to rear-end the 18-wheeler? Was the driver of the Cadillac distracted, or were there other circumstances that limited their ability to avoid the stopped truck? Did the truck have its turn signal activated or any other warning measures in place to alert approaching drivers? Answering these questions is crucial to understanding what happened.

Another critical aspect to investigate is the truck itself. Large vehicles like 18-wheelers are required to have functioning safety features such as lights, reflectors, and emergency signals to ensure they are visible to other drivers, particularly when stopped in a live lane of traffic. Was the truck equipped with the necessary safety features, and were they functioning properly at the time of the crash? If not, could a lack of visibility have contributed to the collision?

Beyond the truck, it’s also essential to examine the role of the trucking company. Trucking companies are responsible for maintaining their vehicles, training their drivers, and enforcing policies that prioritize safety. Did this company meet its obligations to ensure that the truck and driver were fully prepared to operate safely? Were there company policies or practices that may have contributed to this wreck?

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure those impacted by the incident receive the clarity and closure they deserve.
