Commentary by Attorney Michael Grossman

One of the main reasons I started this blog is to address a lot of the misconceptions out there when it comes to car accidents and the laws surrounding them. One of the all-time classics is that a rear-end collision is always the fault of the person doing the rear-ending. That’s simply not true.

The law is nuanced enough to recognize there can be extenuating circumstances where even safe drivers may not be able to slow down. Defective brakes, drivers without their lights, drivers cutting someone off, road hazards, etc. And even in situations where a driver is on their phone, going too fast, or intoxicated, for example, there could still be other extenuating circumstances authorities overlook. Ultimately, folks should just let the evidence speak for itself. Jumping to conclusions never helped anyone, and I don’t see why this crash would be any exception to that.
