Eastland County, TX — August 18, 2024, Rickey Dailey III was injured as the result of an alleged drunk driver accident at 8:45 a.m. along I-20.
Authorities said in initial statements that the accident happened along westbound lanes of the interstate a few miles east of Ranger.

According to officials, 48-year-old Rickey Dailey Jr. was on a Harley-Davidson motorcycle traveling westbound on I-20. While doing so, a Toyota Camry crashed into Dailey, knocking the bike over. As a result, Dailey was seriously injured.
The Toyota driver was allegedly under the influence of alcohol at the time of the accident. They recommended charges for intoxication assault.

It’s not common to see alcohol-related accidents at this time of the morning, but it’s not unheard of, either. In fact, despite this happening outside of the more typical drunk driving hours, I have to wonder where the alleged drunk driver may have got the alcohol from. I’ve handled hundreds of cases against negligent alcohol providers, and there is no shortage of examples of people being unlawfully over-served to the point they’d still be intoxicated well into the morning hours, and that would likely mean any alcohol provider involved here could be in serious trouble.
For example, we had a case not long ago where a bar over-served someone to over four times the legal limit (about a .32 BAC). Now, the human body relatively consistently metabolizes alcohol such that for every hour after someone last drank, they sober up by about one standard drink. So if someone is served to four times the legal limit at last call, usually 2:00 a.m., and they don’t touch a drop of alcohol until 8:45 in the morning, they’d still be nearly three times the legal limit. In fact, it would take them over sixteen hours to just barely be under the legal limit again. As such, there are plenty of times where someone goes out drinking heavily, is unlawfully over-served, then gets up for work just hours later still too drunk to drive.
It’s possible nothing like that happened here, but this is just to help explain why conducting thorough investigations into any alcohol-related crash is so important. This could all be one reckless driver’s mistake, or there may have been an accomplice who broke the law and contributed to the accident. At the end of the day, those affected by crashes like this deserve to know those who harmed them are going to face appropriate consequences.
