Commentary by Attorney Michael Grossman

Authorities allege that the driver of the HHR was over twice the legal limit for drunk driving. If that’s true, have authorities determined where that alcohol came from?

The reason that matters is because alcohol providers often play a role in serious accidents like this. If they illegally over-serve someone, they can face criminal investigations, fines, license suspensions, and even liability if people end up getting hurt. Yet in hundreds of cases I’ve handled against negligent alcohol providers, authorities rarely take steps on their own to investigate beyond the alleged drunk drivers. Once someone is facing charges, they tend to consider their work done. Meanwhile, had it not been for us helping the victims and families confront those alcohol providers, the negligent establishments would simply get off scot-free to continue business as usual. Is that what’s happening here, or have authorities been more thorough in getting the victims the full story they deserve?
