How Did This Accident Occur?

A lot of people look at a rear-end collision and just assume that the rear driver is automatically at fault. That’s not really how the law works. There are plenty of reasons why a driver might hit the back of another vehicle where they didn’t do anything wrong.

For example, was the 18-wheeler clearly visible? I recall researching a crash a while back where a father and son were killed in a rear-end collision. Weeks after the initial reports, it finally came to light that the 18-wheeler merged in front of the pair on a dark highway without its trailer lights on. Obviously, it would be ridiculous to blame a driver for hitting a practically invisible trailer simply because they were unlucky enough to hit it from behind.

To be clear, it is true that a lot of rear-end collisions involve drivers making mistakes and not slowing down in time. I’m not suggesting that possibility be ignored here. My point is that it’s up to the evidence to say what happened here, and that evidence could show that there were factors here the victim had little or no control over. Hopefully authorities are already working to gather that evidence, but it’s up to families to decide if their situation is being treated as a high enough priority.
