As open-and-shut as these initial statements may seem, just having someone to potentially blame is rarely the whole story. For one, there’s a difference between authorities saying a driver was inattentive and victims and families have evidence to prove that a driver was inattentive.
At the end of the day, getting a fair resolution means going through insurance companies who have one priority: avoid responsibility. A preliminary crash investigation may help in that regard, but it’s usually just one piece of the puzzle. Even when details seem straight-forward, victims and families will almost always fare better when they have as much evidence as possible telling their side of the story. That tends to require more thorough investigation than a typical police report alone.
