Commentary by Attorney Michael Grossman
When accidents like this happen, it’s natural to think they stem from simple mistakes or brief lapses in attention. However, based on my experience, rear-end collisions involving large trucks and smaller vehicles often reveal more complicated issues that require careful investigation.
One key question here is why the 18-wheeler failed to avoid the pickup truck. Rear-end collisions usually point to problems with speed management or attention, but in truck accidents, the reasons can be more complex. Investigators will need to consider whether the truck driver was distracted or fatigued, as both are common contributing factors in late reactions and missed signals in traffic. Additionally, in a rural stretch of highway like this, speeds are often high, and stopping distances for large vehicles can become a significant challenge. If the truck driver didn’t allow sufficient following distance, it would have greatly reduced their time to react, increasing the risk of a collision.
Mechanical issues with the 18-wheeler should also be examined as a potential cause. Problems with brake systems or other essential equipment may have impacted the truck’s ability to slow down in time to avoid the crash. Federal regulations require that commercial trucks undergo regular inspections and maintenance to ensure they are roadworthy, and any lapses in this area could indicate shared responsibility on the part of the trucking company.
Ultimately, the goal is to uncover the truth and provide answers to those affected by the accident. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to consider every factor to ensure that those impacted by the accident receive the clarity and closure they deserve.
