Commentary by Attorney Michael Grossman

When incidents like this occur, many assume they result from simple driver error or misjudgment. However, with over 30 years of experience handling commercial vehicle cases, I know these situations are often far more complex. Fatal truck accidents like this one demand thorough investigation to uncover all contributing factors.

What might have caused the 18-wheeler to leave its lane of travel and crash into the California Aqueduct? Could the driver have been fatigued, distracted, or experiencing a medical emergency? Was the truck’s mechanical condition to blame, with potential failures in the brakes, tires, or steering? It’s also essential to consider whether external factors such as roadway conditions, visibility, or signage might have played a role. A proper investigation must explore all possibilities.

The condition and maintenance of the truck itself are critical aspects to examine. Trucks require regular inspections and upkeep to ensure safe operation. Was this vehicle properly maintained? Were its critical systems functioning correctly, or did a preventable mechanical issue lead to the crash? Additionally, safety equipment such as lights and reflectors must be fully operational and visible to alert others to the truck’s presence and movements.

The trucking company’s responsibilities must also be scrutinized. Companies are obligated to ensure their vehicles are roadworthy and their drivers are adequately trained and supervised. Was this driver operating under safe conditions, or did the company impose pressures such as tight schedules or excessive hours behind the wheel? A full inquiry into the company’s practices can reveal whether systemic shortcomings contributed to the incident.

Ultimately, the goal is to uncover the truth and provide answers to those affected by the crash. Even if it requires conducting an independent investigation to obtain critical evidence, it’s essential to examine every factor to ensure that all impacted by the incident receive the clarity and closure they deserve.
