Commentary by Attorney Michael Grossman

People tend to underestimate how complex a multi-car accident can be for the authorities. Besides the normal challenges of investigating a deadly accident, they also have to clear the scene and assist the people involved in the crash. All of this can overwhelm officers if they’re not supported with the time and equipment needed to do their jobs properly. This is when mistakes happen.

Did authorities pull cellphone records? Did they map debris patterns and tire markings? Have they looked for cameras at nearby businesses or residences? Have they analyzed the vehicles for potential defects, either that contributed to the accident or perhaps led to safety feature failures that made the crash more severe? Have they tested for intoxicants? Did they document witness statements and take down their information so they can be contacted later on?

These are all the kinds of details I can reliably expect to see when working with independent accident reconstructionists. With authorities, however, none of this can be taken for granted. Of course, it’s possible authorities here would be able to provide clear answers to all of these questions and more. That can happen when authorities take investigations seriously. However, I’ve had countless cases that came from victims and families being unsatisfied with the responses authorities gave them, leading them to seek out a second set of eyes to fill in the gaps. It wouldn’t be unusual if there were similar concerns here.
