If the allegations here are true, then the alleged drunk driver will no doubt have their day to answer for their actions. But could there be more to this story? It would surprise people how often folks call me about crashes like this, and it turns out authorities never bothered to find out where the drunk driver got their alcohol from. Alcohol providers can also face consequences when their actions contribute to serious accidents like this, but that’s only if they’re actually properly investigated.
There was a case not long ago, for example, where a family was hit by a drunk driver who turned into oncoming traffic. They felt authorities handled things well, but they just wanted a second opinion on the details. When we started asking about where the drunk driver had been drinking, they were confused as to why that mattered. After we finished out investigations, though, they were shocked authorities never bothered conducting their own investigations in the bar that served the drunk driver.
The evidence we gathered showed servers pouring this guy drink after drink after drink in just a matter of a few hours. The man became extremely and obviously intoxicated—he could barely walk to the bathroom without falling over. Still, the drinks kept coming so long as he was buying. Then, they happily let the man stumble his way out of the bar where he then nearly got someone killed. The bar didn’t care about unlawfully over-serving people because they’d never been held accountable. Thankfully, a family just trying to explore all of their options led to the establishment facing consequences, and ultimately cleaning up their act.
Bars and other alcohol providers who conduct themselves in that manner can face criminal investigations, fines, suspended licenses, and liability for injuries resulting from their unlawful over-service. That’s why it’s so frustrating to me when authorities move on simply because there’s a driver facing charges. Perhaps authorities here are being more thorough behind the scenes and just never released their findings publicly. However, I learned a long time ago in my career never to take that for granted. There could be another wrongdoer responsible for what happened here, and they shouldn’t be let off the hook just because no one bothered to look for them.
