Commentary by Attorney Michael Grossman

If it’s true that alcohol was involved here, then it wouldn’t at all be unusual to see the alleged drunk driver face some serious consequences. One of the good things about the Houston area, too, is that authorities are more likely to also find out if the driver was unlawfully over-served by an alcohol provider. Those negligent alcohol providers can also face criminal investigations, fines, and even liability for resulting injuries when they contribute to crashes like this.

Unfortunately, even Harris County officials don’t prioritize investigating negligent bars and the like. It’s an issue all over the state that alcohol providers get away with far too much, and folks don’t even realize there may be avenues to hold them accountable. I’ve handled hundreds of cases against negligent alcohol providers responsible for accidents like this. I can’t count the number of times where speaking to us was the first victims and families had ever even heard that alcohol providers can face consequences for contributing to a serious accident.

Hopefully, this crash is one of the ones where Harris County officials have taken the time and effort to address all contributing factors. That way, no one is let off the hook for mistakes that led to the accident. However, it’s not something I would ever take for granted, which is why there may still need to be further investigations into what happened here.
