Commentary by Attorney Michael Grossman
Single-vehicle accidents can often be more complex than people may realize. Simply put, they’re not always seen as a priority by the authorities. Sometimes, this means they jump to conclusions without considering all possible factors. Other times, they may put to much focus on blame rather than hearing out the victim’s side of the story. That’s when details start to slip through the cracks.
For example, I had a case not long ago where authorities blamed someone for not wearing their seatbelt. The family felt that would have been unusual for the victim to forget, but the authorities had already moved on. We ended up having independent investigators examine the vehicle, and it turned out the seatbelt was defective. The victim ended up suffering serious injuries due to a vehicle defect no one knew about.
Had that crash simply been brushed aside without a second glance, that defect likely would have gone entirely unnoticed. I’m not saying that happened here, but that’s why single-vehicle wrecks can be more challenging than they initially seem. At the end of the day, there should be clear evidence one or the other about what happened.
