Galveston County, TX — October 10, 2024, Phyllis Chavez and one other were injured due to a car accident at around 1:10 p.m. along Main Street.
Authorities said in initial statements that the accident happened at the intersection of Main Street and Devereux Drive.

According to officials, 83-year-old Phyllis Chavez was a passenger in a Honda CR-V being driven westbound on Main Street. From the oncoming lanes, it appears a Ford failed to yield, crashing into the Honda. Phyllis Chavez was seriously injured as a result. The driver of the Honda, a 30-year-old woman, was moderately injured.
Authorities at this time allege that the driver of the Ford was under the influence of alcohol at the time.

If the allegations here are true, that could make this situation a lot more complex than folks may realize. People often see someone accused of intoxicated driving, and they figure things are open-and-shut. But if that driver was unlawfully over-served by an alcohol provider, that could present additional challenges authorities alone may not be equipped to handle.
Simply put, alcohol providers who unlawfully over-serve someone that’s obviously intoxicated can face criminal investigations, fines, suspended licenses, and liability for resulting injuries. I’ve handled hundreds of cases against negligent alcohol providers, though, and rarely do I see authorities conducting their own parallel investigations. A lot of negligent alcohol providers fly under the radar until victims and families are motivated to see they’re getting the whole story, and things come to light in the ensuing independent investigations.
So regardless of what happened here, it’s unlikely that a typical, surface-level investigation would be enough to cover everything. Maybe authorities were thorough enough here not to overlook anything important, but it would be far from the first time a crash like this needed to be in the hands of more experienced independent investigators.
