Waskom, TX — February 6, 2024, Pedro Garcia Marroquin was killed following a work accident that happened at around 10:00 p.m. along Highway 80.

According to initial details about the accident, it happened in the area of 15517 East Highway 80.

Details suggest that 26-year-old Pedro Garcia Marroquin was working on repairs to a water pump at the time. While unscrewing a valve, the pressure reportedly caused a part to blow off and strike Garcia Marroquin. As a result, Garcia Marroquin was killed. No other injuries were reported.

The OSHA investigation summary included twelve alleged violations, ten of which were called “serious.” Additional details can’t be confirmed right now.

Seeing such a long list of alleged rule violations is obviously concerning, but it could lead some folks to mistakenly take this to mean the accident is open-and-shut. For a Texas work fatality, there is no such thing as a simple or straight-forward accident. Texas has the most complex work fatality law of any other state in the country. Families often call me about situations where they thought there was an automatic process for resolving things, but then they find out they’re on their own, and the victim’s former employer is doing everything in their power to work against the family, who likely just wants answers and to see a fair resolution.

That’s why it’s important folks understand the importance of preparing for the legal maze of Texas work fatality law as soon as possible. As many challenges as it can present, those challenges can be overcome with the right evidence, experience, and legal tools. Considering the legal of attention OSHA gave this particular incident, I can’t imagine any steps to prepare a family involved in something like this could ever be too cautious.
