San Antonio, TX — October 31, 2024, a pedestrian was struck and killed by a VIA Metro Transit van while crossing Loop 410 in San Antonio.
Early reports don’t have many specifics yet, but they say the accident happened around 3:40 a.m. on westbound Loop 410 near the exit to Evers Road. Investigators only said that the victim, believed to be a man in his 30s, was trying to run across the lanes when he was hit and critically injured by the Metro van.

The pedestrian was transported to an area hospital, where he died a short time later.

Accidents like this one are all too common, especially in large urban areas like San Antonio. Despite how frequently they happen, though, not everyone understands how the law sees them. Part of that comes from the idea that pedestrians must automatically be at fault if they’re on the highway. It may be dangerous to be on foot there, but that doesn’t mean it’s open season on pedestrians.
Generally speaking, investigating pedestrian collisions is partly about how avoidable the crash really was (or should have been). That means considering all the possible contributing factors: Is that area lit up at night? How fast was the vehicle traveling? Was the driver’s full attention on the road? Where did both the pedestrian and the driver come from before meeting in the road? Was anything on the road that affected the van’s traction? Was it in good repair?
Those and many other details must be clarified before anyone can claim to have the whole story. In the end we may just see a story of a pedestrian poorly timing his crossing, but at least his loved ones will know that no stone was left unturned. If there’s anything else to do besides bring them the truth, that may depend on what the truth turns out to be.
