Commentary by Attorney Michael Grossman

When a pedestrian is struck in a crash involving multiple vehicles, the key question isn’t just what happened, but why it happened. In my experience handling accident cases, wrecks like this rarely occur without multiple contributing factors that need to be examined.

How did the pedestrian end up in the path of traffic? Pedestrians and multi-vehicle collisions are uncommon unless something forces a person into harm’s way. Was the pedestrian crossing the street, walking along the roadway, or caught between vehicles after an initial impact? Investigators should review witness statements, traffic camera footage, and crash scene evidence to determine the pedestrian’s position before the collision.

What caused the vehicles to collide? Reports indicate four separate vehicles were involved, including a truck and trailer. Did one vehicle stop suddenly, forcing a chain reaction? Did the truck or another vehicle fail to see the pedestrian before impact? Investigators should analyze vehicle positioning, speed data, and black box recordings to determine what set off the crash.

Was the truck being used for commercial purposes? Many trucks with trailers are operated for business, which means additional safety regulations may apply. If the truck was being used commercially, investigators need to determine whether the driver was properly trained, following hours-of-service regulations, and operating a vehicle that met all required safety standards. Reviewing company records, driver logs, and maintenance reports could provide insight into whether business-related factors contributed to the wreck.

At the end of the day, the most important thing is finding answers. Even if it takes an independent investigation to gather the right evidence, it’s critical to examine every factor to ensure those affected by the crash get the clarity they deserve.
