One of the most important questions to ask in a pedestrian crash like this one is whether the circumstances gave everyone involved—both the pedestrian and the drivers—a reasonable chance to avoid the collision. Pedestrian accidents near freeway exit ramps are especially complicated, as these areas combine high speeds, limited visibility, and a lack of pedestrian infrastructure.
An essential part of any investigation is determining whether the area where the crash happened was designed with safety in mind. Was there a safe crossing point nearby, or were pedestrians forced to navigate an environment that didn’t account for their presence? Too often, high-speed areas like freeway ramps lack clear crosswalks, signals, or other measures that could help prevent accidents.
Another critical factor to examine is the role of the trucking company. Did the company properly train the tanker truck driver to handle high-risk scenarios, such as navigating busy freeway ramps where pedestrians might be present? Did they enforce reasonable schedules and policies that allowed the driver to stay alert and focused? Trucking companies have a legal obligation to ensure their vehicles and drivers operate safely, and lapses in training, hiring, or supervision could have played a role in the events leading up to the crash. Maintenance records and company policies must be reviewed as part of any thorough investigation.
Finally, it’s also critical to examine the actions of the tanker truck driver and the other drivers involved. Commercial drivers, in particular, are held to a high standard of care. Questions about speed, distraction, and reaction time are crucial. Evidence such as dashcam footage, ELD data, and eyewitness accounts can shed light on whether the drivers involved were operating their vehicles safely and responsibly.
Thorough investigations are vital in cases like this to uncover the full story. Pedestrian accidents often involve a combination of individual decisions, infrastructure issues, and systemic safety challenges. Without looking at all of these factors, there’s no way to truly understand what happened or to hold the right parties accountable and ensure those impacted receive the clarity and closure they deserve.
