Commentary by Attorney Michael Grossman

When I read about incidents like this one, what stands out to me isn’t just what happened, but what’s missing from the conversation. A young person was seriously hurt, and the driver now faces multiple serious charges, including intoxication assault. That alone raises the kinds of questions Texas law was designed to help answer, particularly when it comes to alcohol-related accountability.

One of the most important but often overlooked questions in cases like this is, “Where did the driver get their alcohol?” If the person behind the wheel was indeed intoxicated, there’s a possibility they were overserved at a bar, restaurant or other licensed alcohol provider before the crash. Texas law doesn’t just hold drunk drivers responsible. It also allows those injured to seek answers when a business contributes to a dangerous situation by serving someone who’s clearly had too much.

It’s not always obvious, but there may be more to this story than people realize. That’s exactly why dram shop law exists: to make sure that alcohol service is handled responsibly and that those who suffer the consequences of overservice have a path to accountability.

Three important takeaways:

  1. Dram shop laws exist to hold alcohol providers accountable if they overserve someone who goes on to cause harm.
  2. A full investigation should explore where the driver was drinking, and whether a bar or other licensed provider contributed to this crash by serving someone who was already clearly intoxicated.
  3. Even if most people aren’t aware of these legal tools, they can offer meaningful answers for those who’ve been affected by a serious alcohol-related crash.
