Commentary by Attorney Michael Grossman

When someone is seriously injured in a hit-and-run involving a pedestrian on the interstate, the focus often shifts to locating the driver who fled the scene—and rightfully so. But in my experience, especially in cases like this one, it’s equally important to understand the full picture of how and why the crash occurred. To get those answers, there are three essential questions that should be asked.

First, did investigators evaluate the visibility and roadway conditions at the time of the crash? At just before 3:00 a.m., visibility is naturally low, and if the area lacked proper lighting or signage, it could have affected both the pedestrian’s safety and the driver’s ability to react in time. Assessing lighting, shoulder conditions, and whether the pedestrian was walking near a breakdown lane or in a live traffic lane is crucial to understanding the circumstances of the crash.

Second, has the vehicle involved—reportedly a Chevrolet Silverado—been located and inspected? While the focus is on accountability, it’s also important to consider whether a mechanical failure such as a headlight outage, steering issue, or brake malfunction might have contributed to the driver’s inability to avoid the collision. A thorough inspection could help determine whether the vehicle’s condition played a role, or whether the damage is consistent with the reported impact.

Lastly, has any electronic data or camera footage been preserved? The Silverado likely contains an event data recorder that, if recovered, could show the vehicle’s speed, braking input, and steering movements in the moments before the crash. Additionally, surveillance footage or traffic cameras in the area could confirm the vehicle’s movement, help verify the timeline, and provide clarity about how the pedestrian came to be in the roadway.

When a crash leaves someone seriously injured and the responsible driver leaves the scene, finding that individual is only part of the process. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
