Commentary by Attorney Michael Grossman

Looking at this intersection online, it’s quite the narrow street, and one can understand that visibility at 5 in the morning would be limited. At the same time, where else in the world would a driver most expect to encounter pedestrians than in New York City, even that early in the morning?

One thing which stood out to me in some reports is apparent concerns in recent years of garbage truck companies in the city having trucks work long routes. I’ve handled hundreds of commercial vehicle accidents, and tight, unreasonable schedules is a recipe for disaster. It can lead drivers to take risks they wouldn’t otherwise take, and accidents are all but inevitable. Could it be that such issues led this incident, as well? If nothing else, I’d say it’s worth consideration.
