Commentary by Attorney Michael Grossman
When a pedestrian is seriously injured in a crash involving a full-sized pickup truck, as reportedly occurred along Montgomery Street in Montgomery County, many assume the pedestrian must have been in the roadway or made an unsafe move. But that assumption skips over the most critical part of any serious crash investigation: understanding how the collision happened. In my experience, the only way to do that is by starting with three essential questions—each of which helps uncover details that could otherwise be missed.
First, did authorities conduct a thorough investigation of the scene? Crashes involving pedestrians at night raise immediate concerns about visibility, lighting, and driver attentiveness. Was the area well-lit? Were there sidewalks or shoulders available? Was the pedestrian crossing, walking with traffic, or in the middle of the roadway? Investigators should examine all of these factors, and they should be working to locate any surveillance footage, nearby traffic cameras, or witness statements that can clarify the sequence of events. If these steps weren’t taken—or weren’t documented thoroughly—it’s very possible key facts will remain unknown.
Second, has anyone considered whether a vehicle defect may have contributed to the crash? A failure in the Ford F-150’s headlights, braking system, or steering could have made it harder for the driver to see or avoid the pedestrian, even with reasonable attentiveness. Likewise, electronic safety systems like pedestrian detection or forward collision warning, which are becoming increasingly common in newer pickups, may have failed to activate or perform as expected. These possibilities can only be evaluated through a detailed forensic inspection of the vehicle, and that needs to happen before any repairs or alterations are made.
Finally, has all relevant electronic and digital data been gathered? A Ford F-150 is likely equipped with an event data recorder that captures key metrics—speed, braking, throttle input, and steering behavior—in the moments leading up to the crash. That data can help determine whether the driver had time to respond or made any effort to avoid the pedestrian. Investigators should also pursue dashcam footage, GPS tracking, and cell phone data, both from the driver and the victim, to better understand their movements and actions leading up to the crash.
Answering these three questions is critical to making sure that no stone is left unturned in understanding the causes of a crash like this. Serious wrecks deserve serious investigation, not assumptions. Getting clear answers to these questions is crucial for those seeking to understand what happened and why—and it’s the least that can be done to help those affected find the clarity and closure they deserve.
