Commentary by Attorney Michael Grossman

When a pedestrian is seriously injured in a collision with a vehicle, as occurred on U.S. 59 Business Highway, it is critical to investigate thoroughly to uncover the cause of the crash. Based on my experience, three important questions should guide this process: Did authorities investigate the circumstances of the crash scene thoroughly? Was the Lexus inspected for any defects or maintenance issues? And have additional sources of evidence, such as electronic data or surveillance footage, been reviewed?

First, did authorities carefully examine the crash site? Pedestrian accidents often occur due to a combination of factors, including poor visibility, inadequate lighting, or unclear signage. Was the area well-lit? Were there designated crosswalks or pedestrian warnings in place? Understanding the environment where the collision occurred is vital to identifying all contributing factors.

Second, was the Lexus examined to rule out any potential vehicle issues? While driver behavior is often a focus, mechanical problems—like malfunctioning brakes or lighting—can also play a role in such incidents. It’s essential to ensure that no defects or failures contributed to the collision.

Lastly, has all relevant evidence been analyzed? Witness accounts, dashcam or surveillance footage, and any electronic data from the vehicle could shed light on critical details, such as the pedestrian’s actions leading up to the crash and whether the driver had time to react appropriately. Without this information, assumptions may fill gaps that evidence could clarify.

Accidents like this one, where a pedestrian sustained serious injuries, require a meticulous investigation to uncover every contributing factor. Answering these questions provides a clearer understanding of what happened and why. For the injured man and his loved ones, obtaining these answers is an important step toward clarity and closure.
