Commentary by Attorney Michael Grossman

Pedestrian accidents sometimes cause confusion because not everyone considers them as the complex situations they can sometimes be. A lot of people think it’s just all about whether or not the pedestrian had a signal to cross. That’s important, of course, but it’s just one possible factor. Proper investigations need to also consider if a reasonably prudent driver would have been able to see and avoid the pedestrian. If not, then there’s likely nothing that could have been done on the driver’s part. If so, however, it’s important to find out what prevented the driver involved in the collision from avoid it. Are those details being looked into here?
