UPDATE (February 26, 2024): In more recent statements on the accident, authorities alleged that the driver who hit the pedestrian was under the influence of alcohol at the time of the accident. There was also indication that driver may have been drinking at a local establishment just prior to the accident.

Commentary by Attorney Michael Grossman

I have yet to see any suggestion that authorities are investigating the “local establishment” they mentioned. If that business over-served the driver who hurt the pedestrian, they too could face serious consequences.

Unfortunately, I’ve often helped families confront such alcohol providers only to find authorities weren’t anywhere to be found, and the only reason there were ever criminal charges filed was because we brought the establishment to the attention of authorities. That’s why it is a bit concerning seeing investigators be thorough here yet still not mention anything about investigating the supposed bar or even contacting the Texas Alcoholic Beverage Commission so they can do their own investigations. Have authorities been more thorough than what they’ve said publicly, or is there still more to this story?
