Commentary by Attorney Michael Grossman

When a pedestrian is seriously injured in a roadway collision, especially at night, many are quick to conclude that the individual was simply in the wrong place at the wrong time. But in my experience, pedestrian crashes—like this one along State Highway 249—often involve a number of overlooked elements that demand closer attention. To truly understand how and why this incident occurred, there are three key questions that should be asked.

First, did the authorities conduct a thorough investigation? A nighttime pedestrian collision raises immediate concerns about visibility, road lighting, and signage. Investigators should assess whether there were crosswalks or pedestrian pathways nearby, whether the area was well-lit, and whether the driver had a clear line of sight. Was the pedestrian walking along the shoulder or crossing the road? Were there any visual obstructions or distractions? Without these details, it’s impossible to determine whether the crash was avoidable, and if they weren’t properly documented, an independent review may be necessary.

Second, has anyone considered whether a vehicle defect contributed to the collision? A failure in the Ford Focus’s headlights, braking system, or even a malfunctioning collision avoidance system could have prevented the driver from responding in time. These types of issues are easy to overlook unless a detailed forensic inspection of the vehicle is performed—something that can only happen if the vehicle is preserved after the crash.

Lastly, has all electronic data from the vehicle been collected? The Ford Focus likely contains an event data recorder that captures key information such as speed, braking, and steering input in the seconds before impact. That data can help determine whether the driver attempted to avoid the pedestrian and whether the vehicle responded appropriately. Additional sources like surveillance footage, dashcams, or nearby traffic cameras may also provide crucial context. As always, this information must be secured quickly before it’s lost or overwritten.

In crashes involving pedestrians, especially when serious injuries are involved and the cause remains unclear, it’s not enough to rely on assumptions. Asking these questions is the least that can be done to ensure that those affected by this crash get the clarity and closure they deserve.
